By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Eligibility

By using our Services, you affirm that you are at least 18 years of age or are using our Services under the supervision of a parent or legal guardian. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Use of Services

Our Services are provided for your personal, non-commercial use only. You agree not to:

• Use the Services for any illegal or unauthorized purpose;

• Attempt to gain unauthorized access to any part of the Services;

• Interfere with the functionality or security of the Services;

• Use automated systems to scrape, crawl, or access the Services.

3. Vending Machine Transactions

Our smart coolers are designed for convenience and ease of use. All transactions are processed through secure, contactless, and cashless payment systems.

• Product Availability: Inventory is subject to change and may vary by location.

• Pricing: All prices are displayed at the point of purchase. Taxes may apply where required.

• Refunds: If an item is not dispensed properly or is damaged, please contact us within 48 hours of the transaction at contact@thecooleryvending.com. We reserve the right to refuse refunds for issues reported outside of this time frame or due to misuse.

4. Events and Third-Party Locations

The Coolery may place machines at private events, retail spaces, or commercial venues. In such cases:

• The venue’s policies may also apply;

• We are not responsible for venue-specific issues, such as power outages or access restrictions;

• Hosts or event planners must ensure machines are used in accordance with our terms and operating guidelines.

5. Intellectual Property

All content on the website and vending machines, including but not limited to text, graphics, logos, images, product selections, and the “The Coolery” name and logo, is the property of The Coolery or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or publicly display any content without our prior written consent.

6. Disclaimers

The Coolery makes no warranties, express or implied, regarding the functionality or availability of our Services, the accuracy of product descriptions, or the reliability of product stock levels.

Products are offered “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

In no event shall The Coolery, its officers, directors, employees, partners, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your access to or use of the Services;

• Any unauthorized access to or use of our servers;

• Any bugs, viruses, or similar issues transmitted via the Services;

• Any user content or third-party conduct.

You agree to defend, indemnify, and hold harmless The Coolery and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
